Optional messaging or automation features, including (but not limited to) SMS-based responses such as missed-call text-back, if offered
Optional add-on services or upsells, which may include social media content creation or posting tools
Specific features may change over time and may vary by plan or add-on.
3. Best Efforts Performance
You acknowledge and agree that:
The AI voice agent and any related automation tools are designed to assist with handling inbound communications, but they are not a substitute for human judgment or availability
Business outcomes such as call connection rates, lead quality, bookings, or revenue depend on many factors outside our control and therefore cannot be guaranteed
From time to time, the Service may experience interruptions, delays, transcription inaccuracies, misinterpretations, or temporary unavailability
The Service is provided on an "as-is" and "as-available" basis, and you understand that occasional technical limitations are inherent in software-based and AI-assisted systems.
4. Business Outcome Disclaimer
The Service facilitates communication handling but does not guarantee call connection, message delivery, lead capture, booking, or customer response.
You acknowledge that missed calls, failed connections, delayed notifications, carrier filtering, transcription inaccuracies, or AI interpretation errors may occur.
We are not responsible for lost revenue, missed opportunities, customer dissatisfaction, or business interruption resulting from the use or inability to use the Service.
5. AI Output Disclaimer
AI-generated responses, summaries, transcriptions, classifications, and suggested actions are automatically produced and may contain errors or misinterpretations.
You agree to independently verify important information before relying on it for business decisions.
6. Telecommunications & Carrier Limitations
Messaging and calling functionality relies on third-party telecommunications carriers and networks outside our control.
Delivery, routing, call completion, and message timing are not guaranteed. Messages or calls may be blocked, delayed, filtered, or rejected by carriers, networks, or recipient devices.
You acknowledge that we do not control and are not liable for carrier behavior, spam filtering, regulatory restrictions, or network availability.
7. Notifications & User Responsibility
You are responsible for maintaining access to your notification channels, including email, mobile app notifications, or SMS alerts.
Failure to view or respond to notifications does not constitute service failure or malfunction.
8. Call Recording Compliance
Where call recording or transcription features are used, you are responsible for ensuring proper disclosure and consent in accordance with applicable laws in your operating jurisdiction.
The Service provides recording functionality but does not determine whether recording is lawful in your location.
9. Subscription & Billing
The Service operates on a subscription billing model.
Subscriptions are billed on a recurring basis according to the plan selected at checkout
Any free trial, if offered, will automatically convert to a paid subscription unless canceled before the trial ends
You authorize us to charge your selected payment method on a recurring basis until you cancel
Certain plans may include a monthly allotment of usage at no additional charge. If your usage exceeds the included allotment:
Additional usage may be billed separately
Overage usage will be charged at rates determined by underlying costs incurred or disclosed at the time of billing
Pricing, usage limits, and billing terms may change with notice.
10. Cancellation Policy
You may cancel your subscription at any time through your account dashboard or by contacting support.
Cancellation stops future billing
No prorated refunds are provided for partial billing periods
Access to the Service may continue until the end of the current paid period
11. Payments & Fees
All subscription fees and usage-based charges are billed in advance or as incurred and are non-refundable except where required by applicable law.
Because the Service provides immediate access to digital tools, configurations, and AI-powered features, you acknowledge that fees paid compensate for availability and access to the Service, not for any particular business outcome.
12. Acceptable Use
You agree not to use the Service to:
Violate any applicable laws or regulations, including telemarketing, consumer protection, or data privacy laws
Send unlawful, deceptive, misleading, or harmful communications
Misrepresent your identity, licensing, or business credentials
Abuse or attempt to exploit messaging or calling systems
Violation of these rules may result in suspension or termination without refund.
13. Contractor Compliance Responsibility
You operate your business independently and are responsible for compliance with all laws applicable to your business and communications.
You are solely responsible for compliance with communication laws including, but not limited to, TCPA, telemarketing, consent, and privacy regulations. The Service provides tools only — you determine when and how communications are sent and represent that you have obtained any required consent.
If optional marketing or posting tools are used, you authorize leadportalhub.com to publish content on your behalf where automation is enabled. Such content is not legal or regulatory advice.
You remain responsible for reviewing and updating your marketing presence as necessary to maintain compliance.
14. Data, Privacy & Communications
Your use of the Service is also governed by our Privacy Policy.
By using the Service, you consent to:
The collection and processing of information as described in the Privacy Policy
Communications related to your account, billing, or service updates
15. Service Availability & Changes
We may modify, improve, suspend, or discontinue any part of the Service at any time.
While we make reasonable efforts to maintain availability, we do not guarantee uninterrupted or error-free operation.
16. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, lost profit, or business interruption damages arising from the use or inability to use the Service.
Our total liability shall not exceed the amount paid for the Service during the one (1) month preceding the event giving rise to the claim.
17. Termination
We may suspend or terminate your account if:
You violate these Terms
You misuse the Service
Fraudulent activity or chargebacks occur
Termination does not entitle you to any refund.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
